Community Boards are required to receive notice from any establishment that is requesting a new liquor license or requesting to renew their liquor license at least 30 days before they file an application with the New York State Liquor Authority. The SLA requires proof of the 30 day notice to be submitted with the application. This proof is usually in the form of the certified mail/return receipt slip from the post office.
Once your application is submitted to the Community Board you will be notified in writing when you can appear before the Committee. You MUST be present in order to have your application considered. Anyone that submits a notice of an application for a liquor license that does not appear before the committee when notified of a hearing date, can expect a letter submitted to the NYS Liquor Authority requesting a denial of the application based on insufficient information and the lack of the mandatory presentation before the Board.
Our review of any potential application will be based on the review package submitted and a presentation before the SLA and Sidewalk Cafe Review (SLAC) Committee. The review package, consisting of an extensive checklist, is designed to give us a clear picture of how the proposed establishment will operate and fit into our community. In addition to the information obtained from the checklist, our recommendation to the SLA will also be based on the application presentation at the committee meeting, which contains other information pertaining to the establishment. The presentation consists of a question-and-answer session with the SLAC committee. At the conclusion of your Presentation, the SLAC committee will recommend that the SLA approve, approve with stipulations, or disapprove of your application.
* If the review package is submitted in full and on time, and if the presentation is satisfactory, then a recommendation for outright approval can be expected.
* If, however, the review package is submitted in part or late, deviates substantially from the guidelines as illustrated by the checklist, if the presentation does not provide the requisite information necessary to fully process the application, or if the applicant is unable to answer standard questions regarding the establishment, then a recommendation for disapproval or for approval with stipulations, such as a probationary license period, should be expected instead.
* Review Packages that are not received in full and on time will not be considered for approval.
Please note that the CB 8 Liquor License Application must be submitted to the District office the Wednesday before your hearing (hearing notices are typically mailed approximately 2 1/2 weeks before the meeting) and all establishments must post either the new or renewal hearing notice in a visible location of the proposed establishment for the community to be aware of your plans a minimum of 7 days in advance of the hearing.
